IN THE MATTER HELD BEFORE THE CCMA OF THE GAUTENG REGION, HELD IN JOHANNESBURG Case number MP 000/00 BETWEEN JOHN S NKOSI Applicant And ABC ENTERPRISES Respondent AFFIDAVIT IN SUPPORT OF *RESCISSION APPICATION OF ARBITRATION AWARD BY COMMISSIONER PETERSON DATED 12 AUGUST 2006 I, JOHN NKOSI, hereby declare under oath as follows: I am an adult male, in the employ of the Respondent and hold the position of Human Resources Business Partner. I am duly authorised to make this affidavit. 1 BACKGROUND TO THE FACTS 1.1 In terms of the award of the Commissioner, the Respondent testified that his position was advertised and that he had to re-apply for his own position. He further testified that he received a letter on 1 July 2006 that his application was not successful. 1.2 He further testified that he received a letter of retrenchment and that no process of retrenchment took place.
